Firearm Specific Terms 1. There will be NO INTERNATIONAL BIDDING ON ANY FIREARMS. If you register for the auction and are not in a Jurisdiction that a firearm can freely and legally be shipped to your bidding account will be revoked. 2. All property is sold "AS IS", and ALL SALES ARE FINAL. Property is open to thorough public inspection. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Allen & Marshall Auctioneers and Appraisers, LLC may attempt to describe the merchandise in advertising, via photographs, on the Internet and at the auction but makes no representations. Descriptions including Barrel lengths, Overall lengths, Choke constrictions, Chamber lengths and calibers are believed to be accurate but are subjective. All measurements should be considered +/-. In no event shall Allen & Marshall Auctioneers and Appraisers, LLC be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. Some items may be listed as NIB/New in Box. Buyer should be aware that this is an onsite Auction and several hundred people may handle each firearm over the day preview and auction. Every effort will be made to ensure that each firearm stays in the same condition that it was brought to us and photographed in. However all property is sold "AS IS", and ALL SALES ARE FINAL. The mechanical workings of these firearms have not been tested. We highly recommend that the firearms be checked for their safety and ability to fire by a qualified gun repair shop/gunsmith prior to shooting. 3. It is the perspective bidders responsibility to ensure that the item (s) they purchase can be legally owned in their State, County or Jurisdiction. The firearms will be broken down into 6 categories. #1 ANTIQUE. An Antique is generally a firearm that is made to fire modern metallic ammunition but was made prior to 1898. No paperwork is required to transfer this type of firearm. #2 BLACKPOWDER. A Black powder firearm is not made to fire modern metallic ammunition. No paperwork is required to transfer this type of firearm. Can be exceptions. #3 CURIO & RELIC. A Curio & Relic Firearm has been designated by the by the BATFE as having collector value or is over 50 years old. Only Licensee's who have applied for and received a CURIO & RELIC LICENSE through the BATFE Qualify for this category. #4 MODERN. A Modern firearm is made after 1898 & is required to be transferred via an instant background check by an FFL dealer to transfer the firearm to you. #5 REGULATED. A Regulated Firearm is designated so by the State of Maryland & requires an instant background check & associated paperwork to be completed for the MD State Police. This covers most handguns that fire metallic cased ammunition. This paperwork requires a 7 day (Business Day) waiting period. #6 MD BANNED. This category will contain certain Assault Rifles (AR-15, AK-47, UZI, SKS w/detachable mag, ect?) that the State of Maryland has banned for transfer in the State of Maryland. This type of firearm can't be purchased by a Maryland Resident. It may be sold to residents of other States where that type of firearm is legal to purchase. THE FIREARM TYPES ARE LISTED BELOW IN THE CATALOG. AS A GENERAL RULE THESE ARE NOT SUBJECT TO CHANGE UNLESS A TYPOGRAPHICAL ERROR WAS MADE. Our FFL has the final say on this matter. If a firearm is listed as modern or regulated it is on our FFL dealers ACUISITION & DISPOSITION (A&D) book & will not be changed, I.E. paperwork is required. The only way Firearms listed in categories #3-#6 can be transferred is through a background check, to a FFL Dealer, or if the firearm is a C&R and you have a C&R License. Only the firearms marked as C&R can be transferred as C&R. An Antique or Black Powder firearm can be shipped directly to any buyer in the U.S. If you have questions please bid before you buy as all sales are final. It is the Buyers responsibility to provide the info of an FFL to whom any & all MODERN/REGULATED/MD BANNED firearms must be shipped. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Allen & Marshall Auctioneers and Appraisers, LLC shall endeavor to describe in detail each item and any pertinent information about it. Allen & Marshall Auctioneers and Appraisers, LLC will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold "as is" and that they may not return any item they purchase. We have made every attempt to provide high quality photographs of the items. If any major damage was observed it will be noted. 5. Shipping Instructions for Firearms: Allen & Marshall Auctioneers & our FFL will handle the shipping of all Firearms. Payment for the packing, materials, boxes, insurance, Signature Confirmation, handling & shipping of purchased lots is the sole responsibility of the buyer. Buyer is responsible for the actual cost of shipping. Buyer is Responsible for a $15 Fee per Modern, Regulated or Maryland Banned Firearm for Our FFL Dealer to take the firearm off his books and Transfer it to your FFL Dealer. Buyer is responsible for the actual cost of shipping. Shipping via US Postal Service Priority Mail or UPS. Shipping fees must be paid prior to the items being shipped. Shipping charges will be billed separately from the items won at auction. It may be 14-21 days time from the day that the invoice for items won is charged & the shipping charges are determined & charged. IT SHOULD BE UNDERSTOOD THAT THIS TYPE OF SHIPPING CAN BE VERY EXPENSIVE. NO REFUNDS WILL BE GIVEN IF YOU CHOSE NOT TO HAVE YOUR ITEMS SHIPPED. Shipping will not be available on some larger sized items. These items will be marked in the catalog. If you purchase an item marked with shipping not available the buyer will be responsible for hiring a moving/freight company and pay all associated costs. Those items will have been stored at the Auction location/ our Auction Facility at 8000 Esham Road, Parsonsburg, MD 21849. Allen & Marshall will handle the shipping on all High Capacity Magazines exceeding a Capacity of more than 10 rounds. It is illegal to transfer, sell or handout a magazine in the State of MD with a capacity above 10 Rounds. These magazines will only be shipped out of the State of Mayland to a Jurisdicton where they are legal. Shipping for Non-Firearm Items (Excluding High Capacity Mags): Allen & Marshall Auctioneers will not handle the shipping of Non-Firearm items. All Non Firearm items From Day #1 including all Knives, Bayonets & other edged weapons that require shipping will be out sourced to the UPS Pack and Ship Store located in Seaford, DE at 23000 Sussex Hwy Seaford, DE 19973 Phone: (302) 629-8771. Buyers will be notified when delivery of their items to the UPS Store has been made. This will occur Approx. 1 Week after completion of the Auction. Please don't contact them and inquire how much it will cost to ship an item before the Auction. They have not seen the items ahead of time and will not see the items until we deliver them. You will be responsible for Paying the UPS Store directly. IT SHOULD BE UNDERSTOOD THAT THIS TYPE OF SHIPPING CAN BE VERY EXPENSIVE. NO REFUNDS WILL BE GIVEN IF YOU CHOSE NOT TO HAVE YOUR ITEMS SHIPPED. IT SHOULD ALSO BE UNDERSTOOD THAT WE HAVE NEARLY 2,000 ITEMS IN THIS AUCTION. IF YOU REQUIRE SHIPPING IT IS NORMALLY THE END OF THE FOLLOWING WEEK BEFORE THE ITEMS ARE DELIVERED TO THE UPS STORE. IF WE DROP OFF A FEW HUNDRED BUYERS ITEMS IT WILL TAKE THEM A FEW WEEKS TO GET IT ALL BOXED AND SHIPPED. NOTE: Due to the Large Amount of Items in Day #1 & Day #2 (1,600 Items) we will be splitting the items requiring shipping between two UPS Pack & Ship Stores. Day #1 the Knives and Edged Weapons will be taken to the UPS Store in Seaford DE. Items from Day #2 including Ammo, Shooting Accessories, etc...will be taken to the UPS Pack & Ship Store in Salisbury, MD. ALL Firearms from Day #2 and Day #3 will be shipped by the Auction Co/FFL. _________________________________________________________________________________ General Terms THIS WILL BE A COMBINATION OF A TIMED ONLINE ONLY AUCTION EVENT FOR THURSDAY & A LIVE ONSITE/WEBCAST AUCTION FOR FRIDAY held at www.proxibid.com. In the event that a tied bid is encountered between a HiBid bid and a Proxibid Bid or a Live bid preference will be given to the Live Onsite or Live Proxibid bidder. In no event shall A&M Auctioneers and Appraisers, LLC be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. 3. BIDDER REGISTRATION: Bidder must be 18 years of age or older, and is required to register for each auction. To participate in this Auction prospective bidders must register & provide identification information to establish that you are a valid bidder: At the time of registration, we collect information about you to verify who you are before you can bid. Bidder must submit information found to be current, complete, and accurate for proper identification. We collect credit card information to ensure that you are a qualified buyer. Bidder is responsible for security of his/her bidding number/user name and password, and any and all bids placed under the assigned number/ID. Auctioneer should be notified immediately if Bidder believes his/her bid number, account and/or password have been compromised. There is no cost to register for an auction (A $1 Authorization will be charged when you initially register to validate your credit card by Auctionflex.) The Authorization is never deducted from your account. It verifies that the card being placed on file is legitimate. The Billing information including address will be validated through this authorization. If the Billing information on the Card doesn't match your shipping information the card may be rejected for possible fraud activity. Auction Co, at its sole discretion, reserves the right to terminate any registration, deny any person for any reason permission or access to bid, to reject any and all bids, and to suspend or ban Bidder from bidding. Bidder registration is not transferable or assignable. Highbid User Ratings. Every bidder starts with a reputation of 0 and, with activity, this score goes up or down to a value between -100 (very bad) and 100 (very good). Any bidder with a reputation lower than +1 will have their auction bid permission set to pending. We will verify your information if you are a new bidder with a reputation of "0". Once approved or declined you will receive an email confirmation. If you have a negative user rating/score on Hibid or Proxibid the Auction Co. at its sole discretion may decline any and all bids placed by your account. As a last resort if we find you to be a non paying bidder or using fraudulent registration and/or credit card information you may be permanently declined from bidding at our auctions. Once a new HiBid customer has participated/purchased items in a few auctions you will start to build up positive feedback with a succesful pay and pickup transaction. Once you have a positive feedback rating your account will normally be automatically approved for auctions conducted on HiBid by A&M Auctioneers for a preset bidding amount. That amount is normally equal to the highest priced item in the Auction. If we have a vehicle that is worth $4,000 we would say that $5,000 would be the maximum high bid that would automatically be approved on your account. Anything above that would require approval. NOTE: If you are a new bidder to HiBid/A&M Auctioneers with a "0" feedback rating we will verify your registration information and assign your account a Maximum Preset High bid (Per Item) amount. This amount will be a Maximum of $500 per item and will depend on the Auction. This pre-aproval amount will be reflected in the Bidder Acceptance email once your account has been approved. We reccomend that when bidding place yours bids early so that you will know that your bid will be accepted. Don't wait until the final minute before the item closes to try to bid. In this scenario for example if you had been approved for a $500 max high bid per item and the bidding is already over $500. If you bid $750 your bid will be set to pending, a notification is sent to us and it is nearly impossible to act upon that less than 60 Seconds. If you know you will be bidding higher than the amount that you were approved for in the email contact us prior to the item ending and we can make a manual change. If you are not comfortable or willing to register online which includes placing a credit card on file on our Secure Web server you may enter bids in person at our facility. Bids must be in writing and are legally binding just the same. A Valid Credit Card will still be required on the bid form. Valid Identification will also be required if you are unknown to the Auction Co. We will upload the bids placed by you on your behalf onto the online bidding server. 4. All items offered online will have a minimum starting bid as displayed on the online catalogue. Online bids lower than minimum will not be accepted. 5. CATALOGUE ERRORS & OMISSIONS: If a description does not match a picture in a lot, the description takes precedence. If you find an error please contact the Auction Co. and we will attempt to rectify it. All items are sold on an "as is, where is" basis, with all faults. In the event an item was listed in error or an item can't be located during pick up for any reason, the bidder agrees that their maximum recourse is a full refund of the item in question and that all other items bid on remain binding. By bidding you are acknowledging agreement with the terms above. Do not bid unless you agree to all of these terms. The Bidder is responsible for knowing which item is being bid on. If the Bidder is unsure, they should inquire or not bid. When becoming the winning bidder at auction you have effected a contract and will be expected to pay for items in which you were evidenced to be the successful bidder. Auctioneer will not honor "mistakes". 6. REVIEWING YOUR BIDS: During an auction you can check the status of your bids at anytime by logging into online server. Please be careful when placing bids. Placing a bid is a two step process. When you click bid button it will pull up a window verifying that you want to place that bid. If you want to place the next bid increment that the computer is asking for you can do that. If you desire to increase the amount of your bid this screen will allow you to bid a higher amount. Ensure that you type in the correct amount. If you make an error the Auction Co. can attempt to correct it but it has to be in a timely manner before the item closes. In order to make a correction you must contact the Auction Co. at 410-835-0384. We have a staff member in the office during all online auctions. You are responsible for the bids that you place. Note that no bids can be withdrawn after the auction for any reason. 7. PROGRESSION OF THE AUCTION: Auctions are typically uploaded to the HiBid Auction Platform 30-45 days before the auction is scheduled to end. Some short notice auctions may be online for only 15-30 Days. Each Auction will have a scheduled time that each auctions items will begin closing. If an auction starts closing on a Wednesday night at 5 PM the first lot will be scheduled to close at that time. Depending on the quantity of items in the Auction lots may be scheduled to end anywhere between 30 to 60 seconds a part. Each lot will show a scheduled ending time. If no one bids in the final minute before a lot is scheduled to close that lot will close out. If someone bids within the final minute before that lot is scheduled to close, 1 Extra minute will be added to that lot and that lot only to allow additional time for people to bid.
