Located at the Black Powder Banquet Room, 1007 W. US Hwy. 136, Franklin, NE
This is just west of the Hwy. 10 & US Hwy. 136 intersection on the north side of Franklin.

We will be selling 845 acres of Franklin Co. land that consists of excellent irrigated farmland,
CRP, dry cropland, and pasture land with excellent habitat.

SELLING FOR THE LAOMA A. GRUBE ESTATE

Farm Location:  From Macon, Nebraska go 2 miles south to M Road, then 2 miles east, then 1 mile south, then 1 mile east to the southwest corner of the property.

Method of Sale:  This is a Multi-Parcel auction.  These 4 tracts will be offered separately and in combination and will be sold in the manner best suiting the sellers.  Should any of these tracts sell separately there will be a survey provided at the cost of the sellers.  The acres provided are believed to be accurate, but are used for computation purposes only.  If the total acres are different after any survey, the buyer will still be responsible at closing for the purchase price arrived at the day of the auction. 

TRACT #1

Legal Description:  The Southwest Quarter (SW1/4) of Section Three (3), Township Two North (T2N), Range Fourteen West (R14W) of the 6th P.M., Franklin County, Nebraska.  172 acres more or less.


This tract contains:  *These acres are approximate* 130.2 irrigated acres, 15 acres dry cropland, 7.6 acres CRP, the balance is in grass or treed areas.  This tract includes an 8” irrigation well with an 80 h.p. US motors gear-head and a Lane Bowler pump.  There is also a Chevrolet 454 power-unit.

TRACT #2

Legal Description:  The Northwest Quarter (NW1/4) of Section Three (3), Township Two North (T2N), Range Fourteen West (R14W) of the 6th P.M., Franklin County, Nebraska.  180.5 acres more or less.

This tract contains:  THIS TRACT HAS EXCELLENT DEER, TURKEY, AND UPLAND BIRD HABITAT.  *These acres are approximate* 21.5 irrigated acres, 17.7 acres dry cropland, 8.9 acres CRP, the balance is in pasture, ponds, treed areas, and the building site.  There is a large dam that can be used to water some of the cropland acres.  The house is a 3 bedroom 1 bath home with livestock pens, barn, and a very nice all steel building with a concrete floor.  Details are available in our P.I.P

TRACT #3

Legal Description:  The Southwest Quarter (SW1/4) of Section Thirty-Four (34), Township Three North (T3N), Range Fourteen West (R14W) of the 6th P.M., Franklin County, Nebraska. 160.9 acres more or less.


This tract contains:  This tract is all pasture land with a small pond on it.

TRACT #4

Legal Description:  The Northeast Quarter (NE1/4) of Section Three (3), Township Two North (T2N), Range Fourteen West (R14W) of the 6th P.M., Franklin County, Nebraska.  170.6 acres more or less.


This tract contains: *These acres are approximate* 57 acres of dry cropland, the balance is in pasture land.

Terms: A payment equal to 20% of the purchase price will be due the day of the auction.  The balance will be due on or before December 1st, 2008 by cash, certified funds or a direct wire transfer to the trust account of Ruhter Auction and Realty, Inc.  A title insurance binder will be presented to the purchaser exhibiting marketable title vested in the names of the seller.  Cost of title insurance will be split equally by the buyer and seller.  The 2008 and all prior taxes will be paid by the sellers.  Should the buyer fail to comply with the current CRP contract, all fines and or penalties will be the responsibility of the buyer.  All 2008 crop rent, government payments, and CRP payments will go to the seller.
Possession:  Landlords possession upon closing subject to 2008 crop lease.  Preparation for 2009 crops can be done following the harvest of 2008 growing crops.  Pasture lease for 2008 goes until November 1st, 2008.  The sellers reserve full possession of the building site until closing.  The buyer will be allowed to plant wheat in areas the 2008 crop is removed after making the 20% payment the day of the auction.

Farm location:  From Bloomington, Nebraska, go 3 ½ miles south on road 27 ½ to the north side of the property.

Method of Sale:  This is a Multi-Parcel auction.  These 2 tracts will be offered separately and in combination and will be sold in the manner best suiting the sellers.  If the tracts sell separately there will not be a survey provided.  Any survey of this property will be the responsibility of the buyers.  The acres provided are believed to be accurate, but are used for computation purposes only.  If the total acres are different after any survey, the buyer will still be responsible at closing for the purchase price arrived at the day of the auction.

This tract contains:  *These acres are approximate* 34.8 acres CRP, the balance is in native grass and habitat.  This tract has excellent upland bird, deer, and turkey habitat.
