Legal Description: The Northeast Quarter (NE ¼), Southeast Quarter (SE ¼) of Section Twenty-Three (23), Township Twelve North (T12N), Range Three West (R3W) of the 6^th P.M., York County, Nebraska 40 acres more or less.

Driving Directions to the Farm:  From the intersection of Hwy 81 and the Benedict Spur, go 1 mile west and ½ mile south to the northeast corner of the subject property.

Description of the Farm:  This farm is an excellent producer in an area known for abundant underground water, close to markets and hard surfaced roads.  The soil types are predominantly Hastings Silt Loam and lays very level with adequate drainage.  The farm is currently irrigated from an adjacent irrigation well and pivot system.

Terms:  A payment equal to 20% of the purchase price will be due the day of the auction.  The balance will be due on or before October 17th, 2008 by cash, certified funds or a direct wire transfer to the trust account of Ruhter Auction and Realty, Inc.  A title insurance binder will be presented to the purchaser exhibiting marketable title vested in the names of the seller.  Cost of title insurance will be split equally by the buyer and seller.  The 2008 and all prior taxes will be paid by the sellers.  Possession will be at closing subject to the lease for the 2008 crop year.
