TERMS & CONDITIONS:

The purchaser of each tract shall make 20% deposit with signing of the purchase agreement immediately following the auction. The remainder shall be due on or before January 9, 2009.
POSSESSION: Given upon closing subject to the tenant’s rights through December 31, 2008.
TAXES: 2008 and prior years taxes paid by sellers. 2009 taxes will be the responsibility of the purchaser.
TITLE: A title insurance commitment showing good title will be provided. The cost of the title insurance and escrow fee shall be divided equally among the buyer and seller.
IMPROVEMENTS: The improvements sell in “as is” condition with no warranties.
MINERALS: The sellers will convey all the mineral rights they own, if any.
